The Federal Communications Commission (FCC) has initiated an investigation into ABC’s daytime talk show “The View” as part of its broader enforcement of equal airtime rules for political candidates, according to exclusive information obtained by News outlets. This move stems from the FCC’s recent announcement requiring broadcast networks to comply with the Communications Act of 1934’s “statutory equal opportunities requirement,” which extends to late-night and daytime talk shows. The probe highlights growing scrutiny on media outlets to ensure balanced coverage during election cycles.
Triggering Incident Involving Democratic Candidate
The investigation was prompted by the appearance of Texas Democratic Senate candidate James Talarico on “The View” last month, marking one of the first such guest spots since the FCC’s crackdown began. An FCC source revealed that ABC’s parent company, Disney, did not file an equal-time notice for Talarico’s segment, implying they view the show as “bona fide” news exempt from the rules. However, the FCC has stated there is no evidence that current talk show formats qualify for this exemption, potentially violating the policy.

Equal Time Implications for All Candidates
Under the equal opportunities requirement, all qualified candidates—regardless of party—must receive comparable airtime.
In Talarico’s case, he appeared for about nine minutes, while his Democratic primary rival, Texas Rep. Jasmine Crockett, had roughly 17 minutes across multiple segments prior to the policy announcement. The rule extends to Republican candidates like incumbent Sen. John Cornyn and even lesser-known challengers such as Ahmad Hassan, meaning ABC could need to provide them equivalent exposure or compensatory ads to comply.
FCC Chairman’s Defense and Host Backlash
FCC Chairman Brendan Carr defended the enforcement in an interview, emphasizing that the law dates back to the 1950s and will be upheld under his leadership, with flexibility for networks to meet requirements via news programs or ads. Late-night hosts like Jimmy Kimmel and Stephen Colbert have criticized the policy, with Kimmel calling it a “threat” and Colbert accusing the FCC of attempting to “silence” liberal voices. An FCC source told Fox News Digital, “Fake news is not getting a free pass anymore,” underscoring the agency’s stance against perceived media bias.
