A federal jury in Phoenix, Arizona, recently found ride-hailing giant Uber liable in a significant sexual assault case, ordering the company to pay $8.5 million in compensatory damages to plaintiff Jaylynn Dean.

The incident occurred in November 2023, when Dean, then 19 and celebrating her upcoming flight attendant training graduation, requested an Uber ride from her boyfriend’s apartment in Tempe back to her hotel.

According to the lawsuit, the driver stopped the vehicle partway through the trip, climbed into the back seat, and raped her while she drifted in and out of consciousness, unable to resist.

This bellwether trial—the first of its kind among over 3,000 consolidated federal lawsuits alleging sexual assault and misconduct by Uber drivers—rejected Uber’s long-standing argument that it bears no responsibility because drivers are independent contractors, not employees. Instead, the jury held Uber accountable under the doctrine of apparent agency, determining that the company could be liable for the driver’s actions while operating on its platform.

Notably, the driver involved faced no criminal charges and was not named as a defendant in the civil suit against Uber. The verdict focused solely on the company’s systemic safety failures and its role in presenting drivers as safe and vetted options to passengers. While the jury declined to award punitive damages or find Uber liable for negligence or defective safety systems—resulting in an award far below the $140+ million sought by Dean’s attorneys—the decision is seen as a major precedent that could pave the way for settlements or similar outcomes in the thousands of pending cases nationwide.
