Did the Trump Admin Make This Ruling to Steal European’s Oil ?
The ruling effectively voided the award and halted asset-tracing efforts, triggering multiple volatility trading halts amid heavy selling.
In 2012, Argentina’s government under President Cristina Fernández de Kirchner nationalized 51% of YPF, the country’s largest oil company. The state seized control mainly from Spanish energy giant Repsol, citing insufficient investment and the need to boost domestic energy production. YPF had been privatized in the 1990s and was previously majority-owned by Repsol.
Burford Capital (often referred to as Buford Capital in some reports) saw its shares plummet by more than 40%—with declines reported between 36% and 47%—on Friday following a major legal setback in its long-running YPF litigation against Argentina. A U.S. appeals court, the 2nd Circuit Court of Appeals in Manhattan, overturned a $16.1 billion judgment (which had grown to around $18 billion with interest) against Argentina related to the 2012 nationalization of the state-owned oil company YPF.
The nationalization triggered a major legal dispute. Minority shareholders (including those later backed by Burford Capital) claimed Argentina violated YPF’s bylaws by failing to make a tender offer to buy their shares when it took control. This breach-of-contract argument led to the $16+ billion U.S. court judgment that was recently overturned on appeal.
The decision represents a significant defeat for Burford, as the YPF case was viewed as one of its largest and most valuable investments, often called its “crown jewel.” While the plaintiffs could still pursue further appeals, possibly to the U.S. Supreme Court, the immediate outcome has introduced substantial uncertainty over the timing and likelihood of any recovery. Burford is reviewing the judgment, and the sharp stock drop reflects investor concerns about the firm’s heavy exposure to this high-stakes sovereign litigation. Argentina’s government, including President Milei, celebrated the appeals court victory.
