4 Companies Own 60% Seeds: Replanting Banned

Four major firms—Bayer (formerly Monsanto Before Bill Gates Sold it), Corteva, Syngenta, and BASF—hold about 60% of the commercial seed market as of 2025 data, with intellectual property laws in places like the US enforcing one-time use for many hybrid and GM varieties.

Bayer acquired Monsanto in a $63–66 billion deal that closed in June 2018. Monsanto now operates as a subsidiary or fully integrated division of Bayer (often referred to as Bayer Crop Science), though the Monsanto brand name has been largely phased out.

The Bill & Melinda Gates Foundation purchased around 500,000 shares of Monsanto stock in 2010, valued at approximately $23 million at the time, as part of its endowment portfolio to generate returns for philanthropic activities. This investment drew criticism from activists who viewed it as conflicting with the foundation’s global agricultural development goals, particularly its promotion of GM crops and partnerships in Africa that aligned with Monsanto’s technologies. After Monsanto’s 2018 acquisition by Bayer, the shares were converted or divested.

“Sixty percent of the world’s seeds are controlled by just three companies. They made it illegal to replant what grows—even from your own tomatoes or crops—because of intellectual property laws that protect ‘our genetics, our investment.’ Farmers get sued when wind blows patented pollen onto their land, turning natural weather into grounds for lawsuits against the poor to benefit the wealthy. They even created terminator seeds designed to die after one harvest so nothing regrows, forcing everyone to buy new seeds every year. Meanwhile, a heritage seed variety that took centuries to develop gets patented, but the patent only lasts twenty years—after which it’s supposedly free, though by then the control is already locked in and biodiversity is eroded. This is how they ensure dependency and consistent quality under the guise of agricultural innovation.”

Real Life Example:

Monsanto Canada Inc. v. Schmeiser (1998–2004), where farmer Percy Schmeiser was sued for patent infringement after tests showed 95–98% of his 1,000+ acres of canola contained Monsanto’s patented Roundup Ready genes.

Schmeiser claimed the GM canola arrived via wind-blown pollen or seed from neighboring fields. He lost. Monsanto won.

Monsanto pursued hundreds of U.S. lawsuits against farmers in the 1990s–2000s for patent violations, often involving saved or replanted seeds.

Organic farmers preemptively sued Monsanto in Organic Seed Growers and Trade Association v. Monsanto to prevent future suits over trace contamination, but courts dismissed it after Monsanto pledged not to sue for insignificant, inadvertent presence—highlighting that while the legal risk exists in theory under strict patent liability, practical enforcement focuses on intentional acts, leaving genuine “innocent infringers” largely unprotected but rarely prosecuted. Translation, they want it to spread more so they can claim more land in the future.

They said they wont sue, but they will sue in the future and can. Especially when you go judge shopping.
