Top Surgery Person Wins $2M From New York For Medical Malpractice
Democrat Pro Trans Policies are Fueling Future Malpractice Suits, or detransition lawsuits.
In a landmark legal victory, 22-year-old Fox Varian from Yorktown Heights, New York, won a $2 million malpractice lawsuit against her former psychologist and plastic surgeon after undergoing a double mastectomy (“top surgery”) at age 16 in 2019 while identifying as transgender.

The New York Detransition Lawsuit
Now identifying as a woman and having detransitioned, Varian argued that the providers failed to obtain proper informed consent, deviated from accepted medical standards for gender-affirming care in minors, rushed her into the irreversible procedure without adequately addressing her mental health or explaining long-term risks, ultimately leaving her feeling disfigured for life. The jury awarded her $1.6 million for past and future pain and suffering plus $400,000 for anticipated medical expenses, marking the first successful U.S. detransitioner malpractice verdict to reach trial and result in damages.
Future Malpractice Lawsuits
The recent $2 million verdict in favor of detransitioner Fox Varian highlights a potential wave of future lawsuits stemming from policies in Democrat-led states that support gender-affirming surgeries and treatments for minors, such as those in New York, California, and others that have resisted federal restrictions on such care.
By prioritizing access to puberty blockers, hormone therapies, and irreversible procedures like mastectomies without stringent age limits or comprehensive mental health evaluations, these policies—often aligned with guidelines from organizations like WPATH—may expose medical providers to increased liability as more young people detransition and allege inadequate informed consent or rushed interventions.
With over two dozen similar lawsuits already filed across the U.S. since 2022, involving claims of malpractice in procedures performed on adolescents, experts predict a surge if evidence mounts that such treatments lead to long-term regret, especially in jurisdictions where state laws encourage or protect these practices amid ongoing political debates over youth gender care.
