Top Surgery Person Wins $2M From New York For Medical Malpractice

In a landmark legal victory, 22-year-old Fox Varian from Yorktown Heights, New York, won a $2 million malpractice lawsuit against her former psychologist and plastic surgeon after undergoing a double mastectomy (“top surgery”) at age 16 in 2019 while identifying as transgender.

Now identifying as a woman and having detransitioned, Varian argued that the providers failed to obtain proper informed consent, deviated from accepted medical standards for gender-affirming care in minors, rushed her into the irreversible procedure without adequately addressing her mental health or explaining long-term risks, ultimately leaving her feeling disfigured for life. The jury awarded her $1.6 million for past and future pain and suffering plus $400,000 for anticipated medical expenses, marking the first successful U.S. detransitioner malpractice verdict to reach trial and result in damages.
