It was a Freedom of Information Act (FOIA) lawsuit brought by Grant F. Smith (pro se, on behalf of the Institute for Research: Middle Eastern Policy / IRmep). The suit sought to compel the CIA to release thousands of withheld files—including operational records—concerning the alleged diversion of hundreds of kilograms of weapons-grade highly enriched uranium from the NUMEC plant in Apollo, Pennsylvania, to Israel’s nuclear program in the 1960s.
In 2015, researcher Grant F. Smith of the Institute for Research: Middle Eastern Policy sued the CIA in federal court to compel the release of what the agency acknowledged were thousands of files related to the suspected diversion of hundreds of kilograms of weapons-grade highly enriched uranium (HEU) from the Nuclear Materials and Equipment Corporation (NUMEC) plant in Apollo, Pennsylvania, during the 1960s.
In March 2017, the court granted the CIA’s motion for summary judgment, ruling that the agency had conducted an adequate search, properly invoked exemptions (primarily Exemption 1 for classified information), and released all reasonably segregable non-exempt portions. The plaintiff’s attempts to amend the complaint were denied.
The full complaint and related filings are publicly available on the IRmep website. Some additional CIA documents on the NUMEC affair were released through this and parallel FOIA efforts, though many operational files remain withheld.
The lawsuit stemmed from long-standing allegations in the so-called NUMEC or Apollo affair, where U.S. government records showed over 300 kilograms of U-235 (enough for multiple nuclear weapons) went unaccounted for between 1957 and 1978, with the largest unexplained losses occurring under NUMEC’s operation.
The CIA internally concluded that a significant portion of the missing bomb-grade material was diverted to Israel’s clandestine nuclear weapons program at Dimona, based on factors including NUMEC president Zalman Shapiro’s close ties to Israeli officials and intelligence operatives (including a 1968 visit by top Mossad-linked figure Rafi Eitan), environmental samples taken near Dimona matching the unique enrichment signature of U.S. Portsmouth-produced HEU, eyewitness accounts of suspicious nighttime shipments, and high-level briefings such as CIA Deputy Director Carl Duckett’s 1976 statement to Nuclear Regulatory Commission officials that the agency believed the uranium ended up in Israeli bombs.
Despite investigations by the Atomic Energy Commission, FBI, GAO, and others—some of which criticized the probes as inadequate and noted possible cover-up elements—no criminal charges were ever filed, and many CIA operational files remained withheld under FOIA exemptions for sources and methods. The case highlighted tensions over nuclear non-proliferation, with some declassified documents suggesting high-level U.S. officials weighed plausible deniability amid fears of diplomatic fallout. The NUMEC site later required a costly environmental cleanup borne by U.S. taxpayers. While the full extent of any diversion remains debated and unproven in court, the episode continues to fuel discussion about one of the most contentious suspected nuclear material thefts in U.S. history.
