In August 2025, Jeanine Pirro, serving as the U.S. Attorney for the District of Columbia, made an extraordinary public appeal that underscored the depth of the Justice Departmentโ€™s staffing crisis. Appearing on Fox News, she openly acknowledged that her officeโ€”the largest and one of the most high-profile U.S. Attorneyโ€™s offices in the countryโ€”was short by approximately 90 prosecutors. Rather than downplaying the shortage or issuing a standard recruitment notice, Pirro took the unusual step of directly inviting qualified lawyers to bypass traditional application channels and simply email their rรฉsumรฉs to her. This candid, almost desperate call for help highlighted how severely depleted the office had become amid mass departures, firings, and slow replacement hiring under the new administration.

According to estimates from the advocacy group Justice Connection, around 5,500 individualsโ€”not all attorneysโ€”have quit, been fired, or accepted a buyout offer from the administration.

Prior to these changes, approximately 10,000 attorneys worked across the department and its components, including the FBI. While the department has not released a precise breakdown of attorney departures, officials have not disputed the existence of widespread vacancies.

This staffing crisis marks a sharp departure from the Justice Department’s long-standing reputation as a highly desirable employer for top graduates from the nation’s leading law schools and prestigious law firms.

Elite Attorneys Shun DOJ Jobs Over Fear of Being Targeted By Democrat News

Multiple sources familiar with hiring trends at elite institutions and within the department report a dramatic decline in applications from recent graduates across the political spectrum. The share of qualified candidates applying for positions has plummeted, making it difficult to fill open roles. U.S. attorneys’ offices nationwide are seeing unusually high turnover during this administration transition.

For example, in August, U.S. Attorney for D.C. Jeanine Pirro publicly stated on Fox News that her office was short 90 prosecutors and invited interested lawyers to email their rรฉsumรฉs directly.

Similarly, U.S. Attorney Andrew Boutros in Chicago sent an email to former prosecutors urging them to apply and to forward the message to others who might be interested.Former federal prosecutor Mark Rotert, who served in Chicago in the 1980s and 1990s, described the current situation as astonishing, noting that the office once attracted highly competitive candidatesโ€”even those with extensive trial experienceโ€”yet now appeared desperate for applicants. William Treanor, former dean of Georgetown University Law Center, emphasized that the Justice Department had historically been one of the most attractive destinations for graduates, but applications had fallen to virtually none from his institution, representing a very dramatic shift.

Many attorneys interested in public service are instead choosing positions with state governments, where qualified candidates are surging into attorneys general offices. Some view the reduced interest from graduates of top schools like Georgetown, Yale, and Harvard as positive, aligning with criticisms from both parties that the legal profession has become too elite. The Trump administration has repeatedly criticized the department’s workforce as overly liberal and prone to undermining the president, while also targeting top universities over admissions and diversity policies. In one instance, acting D.C. prosecutor Ed Martin wrote to Treanor stating that his office would not hire from law schools with certain DEI policies, though the department denies blacklisting any specific schools.

If the administration successfully fills most vacancies, the career workforce could undergo a major ideological shift. Current applicants tend to be more conservative and ideologically aligned with the president, often coming from Republican congressional offices, conservative advocacy groups, or with limited prosecutorial experience. Some are young attorneys or mid- to late-career lawyers lacking relevant backgrounds. The department emphasizes its commitment to hiring the best-qualified individuals focused on law enforcement and public safety. However, employment law experts express concern that hiring practices may circumvent rules designed to keep politics out of career positions. Job applications now require applicants to describe a significant Trump executive order or policy and explain how they would advance itโ€”a question experts say indirectly tests loyalty to the president.

While political appointeesโ€”often from Republican state solicitors general offices or conservative groupsโ€”handle high-profile cases, numerous career attorney positions remain open, essential for managing the department’s routine caseload. Traditional hires typically featured top law school graduates with federal clerkships and big-firm experience, a profile that appears to be changing. Hiring has also been slowed by a government shutdown, additional approval requirements, and bureaucratic delays.

In the interim, remaining attorneys in heavily impacted divisions are overburdened and struggling to handle incoming cases and complaints.

The Civil Rights Division, for instance, has lost the vast majority of its 600 employees and filled only about a dozen positions, despite its leader Harmeet K. Dhillon publicly highlighting a flood of applications. After the election, then-Attorney General Merrick Garland urged career staff to stay for continuity and to resist politicization, but under Attorney General Pam Bondi, veteran prosecutors involved in Biden-era cases perceived as anti-Trumpโ€”especially Jan. 6 Capitol riot prosecutionsโ€”have been pushed out. At least 200 individuals have been removed, including about 80 immigration judges, contributing to growing backlogs in immigration courts.

Government lawyers earn significantly less than in the private sector, where first-year associates at major private firms can exceed $230,000 before bonuses, compared to starting salaries around $70,000 for public prosecutors in some locations. The traditional appeal of public service and job security has been undermined by widespread firings, and some potential applicants fear being pressured into ethically questionable cases. As a result, more lawyers are turning to private firms, intensifying competition for those roles and further complicating the Justice Department’s recruitment efforts.
