When Soldiers Must Say No: Disobeying Illegal Military Orders

Unlawful Orders in the U.S. Military: Your Right to Refuse. U.S. troops are bound by the Uniform Code of Military Justice (UCMJ), particularly Articles 90, 91, and 92, which require obedience to lawful orders from superiors. However, service members have both the right and the duty to disobey unlawful orders—those that are patently or manifestly illegal, such as directives that violate the U.S. Constitution, federal law, the laws of war (including the Geneva Conventions), or require the commission of a crime like murder, torture, or targeting civilians. The Manual for Courts-Martial establishes a strong presumption that orders are lawful, meaning troops must generally obey first and challenge later through proper channels, but this presumption does not apply to blatantly illegal commands that a “person of ordinary sense and understanding” would recognize as criminal. Disobeying in such cases protects the individual from later prosecution, as following a manifestly unlawful order offers no defense under military law.

When facing a potentially unlawful order, U.S. troops should first seek clarification from the issuing authority if time allows, document the order and their concerns, and consult available legal resources such as a judge advocate (JAG) officer or chain of command superiors. If the order remains clearly illegal—examples include orders to commit war crimes or violate constitutional rights—the service member must refuse it to avoid personal liability. Refusal can still lead to immediate disciplinary action or court-martial if the order is later deemed lawful, placing significant risk on the individual, who bears the burden of proving unlawfulness. Training emphasizes this balance to maintain discipline while upholding ethical and legal standards rooted in the service member’s oath to the Constitution.
